General Terms and Conditions of Ghent Surf & Snowboard Sports
Article 1. Binding to these general terms and conditions
1.1These terms and conditions apply to all offers and agreements whereby Van Gent Surf & Snowboardsport supplies goods and services of any nature to the customer and/or customer.

Article 2. Quotations
2.1All quotations or offers made by Van Gent Surf & Snowboardsport are entirely without obligation.
2.2Quotes are valid for a maximum of 15 days, unless stated otherwise.
2.3Van Gent Surf & Snowboardsport reserves the right to withdraw a quote without being liable to the customer in any way.
Article 3. Changes
3.1Van Gent Surf & Snowboardsport reserves the right to change or supplement the agreement and/or these conditions, of which Van Gent Surf & Snowboardsport will notify the customer for at least one month before the change takes effect. If the customer does not accept the change, he can terminate the agreement on this date up to one week before the date on which the change takes effect.
3.2If a change in the price occurs after the conclusion of the agreement but before using the services of Van Gent Surf & Snowboardsport, the change will not affect the agreed price if this occurs within three months after entering into the agreement.
3.3Other changes to the agreement with Van Gent Surf & Snowboardsport and deviations from these general terms and conditions will only be effective if they are agreed in writing between Van Gent Surf & Snowboardsport and the subscriber. have been agreed.
Article 4. Additional work
4.1Insofar as Van Gent Surf & Snowboardsport has to carry out work for the customer for whatever reason, which is not included in the agreement between the parties, or costs arise because the customer has failed in any way and therefore makes the execution of the agreement difficult or impossible, these activities and/or costs will be considered as additional work and will be charged extra.
Article 5. Delivery
5.1Delivery means the commissioning of the connections referred to in the agreement and the delivery of the agreed work, without prejudice to the provisions of Article 4.
Article 6. Payment
6.1All prices include 21% VAT, unless otherwise agreed.
6.2If the customer does not pay the amounts due within the agreed period, the customer will owe statutory interest on the outstanding amount without any notice of default being required. If the customer continues to fail to pay the claim after notice of default, the claim can be outsourced, in which case the customer, in addition to the total amount then owed, will also be obliged to pay full compensation for extrajudicial costs, which costs amount to 15% of the total amount. amount, with a minimum of euro 125.00, will be determined.
6.3Van Gent Surf & Snowboardsport reserves the right to disconnect the customer from the system and/or cancel a domain name without any prior warning if payment is not made on time, without being liable for the consequences thereof.
Article 7. Intellectual property rights
7.1All intellectual property rights to the software, equipment and other materials such as analyses, designs, documentation, reports, quotations as well as preparatory material thereof, rest exclusively with Van Gent Surf & Snowboardsport or its licensors, unless expressly agreed otherwise in writing.
Article 8. Confidentiality and Security
8.1Van Gent Surf & Snowboardsport will make every effort to take such measures that confidentiality is maintained with regard to customer data, of which it is clear that the customer has wishes data to be kept confidential.

Article 9. Obligations of the customer
9.1By using the services, the customer will not violate the rights of third parties, will not behave in an indecent manner towards third parties or contrary to good morals or public order, and do not cause damage to third parties. Among other things, the customer will:
a.respect the intellectual property rights of third parties;
b.not distribute data in violation of legal provisions;
c.not attempt to gain access to computer systems for which he or she is not authorized;
d.do not change, delete, make unusable or add third-party data without the consent of the third party in question;
e.do not spread viruses
f.not use the services in such a way that the correct functioning of the computer systems of Van Gent Surf & Snowboardsport is prevented, or that other customers of Van Gent Surf & Snowboard sports are hindered in the use of the services.
9.2Without prejudice to its other rights, Van Gent Surf & Snowboardsport reserves the right to suspend its obligations towards the customer, including by immediately denying the customer access to to deny the use of the services, or any part thereof, if the customer acts contrary to the provisions of this article. Van Gent Surf & Snowboardsport will never be obliged to pay any compensation due to such suspension.
9.3If a publication made public by the customer through the services is unmistakably unlawful and this comes to the attention of Van Gent Surf & Snowboardsport, Van Gent Surf can & Snowboardsport summons the customer to remove the relevant publication as soon as possible, but in any case within twenty-four (24) hours. If the customer does not comply with this demand, Van Gent Surf & Snowboardsport will remove the publication from its systems. Van Gent Surf & Snowboardsport will never be liable for any compensation due to such removal.
Article 10. Dissolution
10.1Van Gent Surf & Snowboardsport is at all times entitled to the extent that it appears at any time that the customer has provided false or incorrect personal data, or that it appears that the customer the agreement has been entered into under false pretenses, to suspend the execution of the agreement or - if the agreement between Van Gent Surf & Snowboardsport and the customer is governed by Dutch law and the seriousness of the case justifies this - to dissolve it. During the period of suspension, the customer remains obliged to pay.
10.2Without prejudice to the other provisions, the agreement will be terminated without judicial intervention at the time when the customer is declared bankrupt, applies for a provisional suspension of payments, or by seizure, is placed under guardianship or otherwise loses the power to dispose of his assets or parts thereof.
Article 11. 21 day money back scheme
11.1Returns and deregistrations of Van Gent Surf & Snowboardsport items are possible within 21 days of the invoice date, provided they have not been used or damaged. Return costs are for the customer himself.
Article 12. Applicable law
12.1Dutch law applies to the agreement between Van Gent Surf & Snowboardsport and the customer.
Article 13. Service and warranty procedure
13.1If there is anything wrong after receipt, you must inform us immediately by email or telephone. After consultation, you can only return the products with the original purchase receipt at your expense.
13.2If a product breaks during the warranty period (usually 1 year), you can contact us. We ensure correct handling.
13.3If it turns out that it is not a warranty case, or if no errors have been made on our part, all costs will be passed on to you.
Transport damage
Van Gent Surf & Snowboardsport is not responsible for transport damage caused by carriers. Never sign off upon receipt if the box is damaged. First check the contents and then sign for the defect or have the carrier sign for it.
Van Gent Surf & Snowboardsport will only process the buyer's data in accordance with its privacy policy. The website contains a Privacy Statement.
Indirect costs caused by the defective item being temporarily out of service are not eligible for reimbursement.
In the event of late payment, Van Gent Surf & Snowboardsport is entitled to terminate the agreement with immediate effect or to suspend (further) delivery until the buyer has fully fulfilled his payment obligations, including the payment of interest and costs due.
Orders are delivered as quickly as possible. In principle, Van Gent Surf & Snowboardsport strives to ship orders placed on a working day within 24 hours. The final delivery period is 30 days after receipt of the order, with the exception of advance payments, where the final delivery period is 30 days after receipt of payment. The stated delivery time is only an indication, therefore no rights can be derived from it.
